Terms of Service

1. Agreement to terms

By accessing avenzaai.com, creating an account, uploading materials, publishing a survey, or making a payment, you agree to these Terms of Service and our Privacy Policy.

If you use Avenza on behalf of an institution or organisation, you represent that you have authority to bind that entity. "You" and "your" refer to the individual or entity using the service.

2. The service

Avenza AI provides a cloud platform for researchers to:

• Upload Word (.docx) and PDF questionnaires for AI-assisted parsing
• Create surveys manually or generate drafts with AI from a research topic
• Publish live survey links, collect responses, and view dashboards
• Export data (CSV, Excel) and purchase analysis add-ons (Quantitative Analysis, Thematic Analysis)

Features may evolve over time. We may add, modify, or retire features with reasonable notice where practicable. Features marked as roadmap items (such as Inferential Analysis) are not guaranteed until publicly launched.

3. Accounts & security

• You must provide accurate registration information and keep it updated
• Email verification is required before full account access
• You are responsible for safeguarding your password and all activity under your account
• Notify us immediately through the contact form if you suspect unauthorised access
• One person may not share credentials; institutional accounts may have separate arrangements

4. Research responsibilities

As a researcher using Avenza, you are responsible for:

• Ensuring your survey complies with applicable ethics, institutional review, and data protection requirements
• Providing accurate informed consent and purpose statements to respondents
• Obtaining necessary permissions for uploaded questionnaires and collected data
• Reviewing AI-parsed questions and AI-generated reports before academic, professional, or publication use
• Responding to respondent enquiries about how their data is used when you are the data controller

5. Acceptable use

You agree not to:

• Upload unlawful, defamatory, harassing, or malicious content
• Collect data without appropriate consent or legal basis
• Attempt to bypass security, rate limits, payment requirements, or access controls
• Use automated bots to create accounts, submit responses, or abuse AI endpoints
• Reverse engineer, scrape, or resell the service without written permission
• Interfere with other users' surveys or the platform's stability

We may suspend or terminate accounts that violate these rules, with or without notice depending on severity.

6. Payments & refunds

Avenza uses a pay-per-survey model processed through Paystack (NGN and USD):

• Welcome activation — One free survey activation per new account (upload or manual create)
• Upload / Create — Paid activation for additional surveys
• Generate with AI — Higher activation tier including AI questionnaire generation
• Quantitative Analysis — Add-on Word report for closed-ended data (₦5,000 / $5)
• Thematic Analysis — Add-on for open-ended synthesis (₦10,000 / $10)

Prices are displayed at purchase time based on your detected currency region. Payment must succeed before entitlements unlock. Refund requests are handled case-by-case for failed deliveries or duplicate charges — submit via the contact form (Sales).

7. Intellectual property

Your content: You retain ownership of questionnaires, survey content, and response data you upload or collect. You grant Avenza a limited licence to host, process, display, and analyse this content solely to provide the service.

Our platform: Avenza's software, branding, documentation, and underlying technology remain our property. These Terms do not grant you ownership of the platform itself.

AI outputs: Reports and parsed structures generated for your account are licensed to you for your research use, subject to Section 8.

8. AI outputs disclaimer

AI-assisted parsing, generation, and analysis may contain errors. You must review all AI outputs before publishing surveys or submitting reports to supervisors, journals, or institutions.

Avenza labels AI-assisted content clearly. We do not guarantee that AI outputs meet any specific academic standard, statistical requirement, or publication guideline. You remain solely responsible for the final content you publish or submit.

9. Service availability

We aim for high availability but do not guarantee uninterrupted access. Maintenance, third-party outages (payment, AI providers, hosting), or force majeure events may cause temporary downtime.

We are not liable for delays caused by factors outside our reasonable control. Status updates for significant outages may be communicated through our support channels.

10. Limitation of liability

To the fullest extent permitted by law, Avenza and its operators shall not be liable for indirect, incidental, special, consequential, or punitive damages, including lost data, lost profits, or research delays.

Our total liability for any claim arising from these Terms or your use of the service is limited to the amount you paid to Avenza in the twelve (12) months preceding the claim.

Some jurisdictions do not allow certain limitations — in those cases, our liability is limited to the minimum permitted by law.

11. Termination & changes

You may stop using Avenza at any time. You may request account deletion through the contact form.

We may suspend or terminate access for violations of these Terms, non-payment, or extended inactivity. Upon termination, your right to use the service ceases; data retention is governed by our Privacy Policy.

We may update these Terms. Material changes will be posted here with an updated effective date. Continued use after changes constitutes acceptance.
